Consumer rights come first
If you are a consumer, these terms do not exclude or limit rights that cannot legally be excluded. Where a mandatory consumer right conflicts with these terms, that right applies.
About us and these terms
The website is operated by Vogue Plastics Machinery Ltd, registered in England and Wales under company number 03136154, with its registered office at Primary House, Spring Gardens, Macclesfield, Cheshire, SK10 2AP, United Kingdom. “Vogue Plastics”, “we”, “us” and “our” refer to that company.
By using the website you agree to the website provisions in these terms. If you place an order, the sales provisions also apply. Our Delivery and Returns pages form part of the information provided before an online order.
Products, machinery and availability
We take reasonable care to describe goods accurately. Product photographs form part of the description, but colours and scale may vary by screen. Used and refurbished goods may have wear, previous repairs, markings or cosmetic damage consistent with the stated condition.
Availability, condition and specifications of machinery and quote-only goods must be confirmed. An enquiry, sourcing request or website listing is not a promise that machinery is available and does not reserve an item.
Unless expressly stated, we do not represent that we are an authorised distributor of a named manufacturer. Manufacturer names and part numbers may be used for identification and compatibility reference.
Compatibility and safe use
You are responsible for checking part numbers, machine model and serial information, dimensions, ratings, connections, software versions and suitability for the intended application before ordering. Contact us before purchase if anything is uncertain.
Installation, testing and use must be carried out by a suitably competent person in accordance with applicable safety rules, manufacturer information and workplace requirements. Guidance from us does not replace an installer's or operator's risk assessment.
Prices, VAT and payment
Prices are shown in the stated currency. Product prices are normally displayed excluding VAT, with VAT and the total payable shown before payment where online checkout is available. Delivery and any additional agreed charge are shown separately.
Obvious pricing or description errors do not bind us. If we identify an error before acceptance, we will explain it and allow you to proceed on the corrected basis or cancel.
Online card payments are processed by our payment provider; we do not receive complete card details. Quote-only orders are payable using the method and schedule stated in the quotation or invoice.
Orders and contract formation
Submitting an order is an offer to buy. An automated acknowledgement confirms receipt but is not acceptance. A contract is formed when we send an express order acceptance or dispatch the goods, whichever occurs first. We may decline an order before acceptance, including where stock, pricing, delivery, sanctions, fraud checks or compatibility information prevents fulfilment. Any payment taken for a declined order will be returned.
Machinery, sourcing, refurbishment and specially quoted transactions form a contract only when both parties accept the applicable written quotation or agreement. That document takes priority if it conflicts with these general terms.
Delivery, title and risk
Delivery and collection are governed by our Delivery and Collection Policy and any order-specific terms. Title to goods passes when we receive cleared payment in full. Risk passes at the point stated in the delivery policy or the applicable quotation.
Cancellation, returns and faults
Consumer cancellation rights, return times, refunds and faulty-goods remedies are set out in our Returns and Cancellation Policy. Business customers do not have statutory consumer cancellation rights, and business returns require written agreement unless another contractual or legal remedy applies.
Our responsibility
Nothing in these terms excludes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, breach of terms implied by section 12 of the Sale of Goods Act 1979, defective products under the Consumer Protection Act 1987, or any liability that cannot lawfully be excluded.
For consumers, we are responsible for foreseeable loss caused by our breach or failure to use reasonable care and skill. We are not responsible for business losses suffered by a consumer.
For business customers only, and subject to the first paragraph of this section, we are not liable for loss of profit, revenue, business, production, contracts, anticipated savings, data, goodwill or any indirect or consequential loss. Our total aggregate liability arising from an order will not exceed the amount paid for that order, except where a separately agreed written contract states otherwise.
Events outside our control
We are not responsible for delay or failure caused by circumstances outside our reasonable control. We will take reasonable steps to reduce the effect and contact affected customers. Consumer cancellation rights remain available where the law provides them.
Website use and intellectual property
You may use the website for lawful browsing, enquiries and purchases. Do not attempt unauthorised access, introduce malicious code, scrape protected account information, interfere with operation, or use content in a misleading or infringing way.
Website design, original text, branding and other original material are owned by or licensed to us. Third-party trade marks, product images and materials remain the property of their respective owners.
Other legal provisions
If part of these terms is unenforceable, the remaining provisions continue. A delay in enforcing a right is not a waiver. No person other than you and us has a right to enforce the contract unless expressly stated.
English law governs these terms. Consumers may bring proceedings in the courts available under mandatory consumer law. For business customers, the courts of England and Wales have exclusive jurisdiction.
